The Ministry of Trade (“Kemendag”) confirmed that discussions are still ongoing regarding the Draft Regulation of the Minister of Trade (“Permendag”) on the Fourth Amendment to Regulation of the Minister of Trade No. 6 of 2026 on Goods Prohibited from Export. The proposed regulation is intended to govern the export management of rare earth metals (“REMs”).
Director General of Foreign Trade at the Kemendag, Tommy Andana, stated that discussions on the draft regulation are ongoing and involve several ministries and government agencies. Its formulation refers to technical provisions issued by the Ministry of Energy and Mineral Resources (Energi dan Sumber Daya Mineral – “ESDM”), as well as an academic study conducted by the Mineral Industry Agency (BIM) concerning critical minerals and REMs recovered as associated minerals from exported mining products.
“We are still conducting studies with the Mineral Industry Agency regarding associated minerals,” Tommy told Hukumonline.
Tommy aims to finalize discussions on the draft regulation as soon as possible. Kemendag also confirmed that its provisions would be aligned with other regulations currently being prepared by the government concerning critical minerals and REMs, including the Draft Regulation of the President (“Draft Regulation”) on Rare Earth Metal Export Management being prepared by the Mineral Industry Agency.
