
Ministry of Trade to Revise PMSE Regulation if It Burdens Business Actors

The Ministry of Trade has opened the possibility of revising Regulation of the Minister of Trade No. 19 of 2026 on the Implementation of Trading Through Electronic Systems (Perdagangan Melalui Sistem Elektronik – “PMSE”) (“PMSE Regulation”). Director General of Domestic Trade at the Ministry of Trade Iqbal Shoffan Shofwan said that a revision may be made if the provisions in the regulation are difficult for business actors to comply with.
“If there are obligations under the regulation that are difficult for business actors to fulfill, we will consider revising it,” he told Hukumonline.
According to Iqbal, regulations are essentially dynamic and need to be adjusted to conditions in the field. Therefore, his ministry continues to evaluate the implementation of the PMSE Regulation. The results will be taken into consideration in determining the need for a revision.
On the other hand, Iqbal said that consideration of a revision to the PMSE regulations also needs to take into account other sectoral regulations. One of these is the Regulation of the Minister of Micro, Small, and Medium Enterprises (Usaha Mikro, Kecil, dan Menengah – “UMKM”), which provides incentives and regulates specific rights and obligations for UMKM and electronic commerce platforms.
