The Ministry of Communication and Digital Affairs (Kementerian Komunikasi dan Digital–      “ Komdigi ”) has revealed the latest news regarding the progress of the derivative regulations of Law No. 27 of 2022 (“ UU 27/2022 ”) on Personal Data Protection           (“ PDP ”)     . The discussion of this policy has only reached 80% of the total 236 Articles, the process of which involves many parties across ministries and agencies     .

“The closest thing is to fix the National Data Center      (Pusat Data Nasional–      “ PDN ”) because before implementing the downstream, namely Draft Regulation of the Government onthe Implementing Regulations of           UU 27/2022      (“ RPP PDP ”), kita matangkan dulu hulu tempat dari sumber data itu akan dikelola. we will first finalize the upstream where the data source will be managed. After all, updating security many times can still be attacked,” said a Komdigi official who did not want to be named to Hukumonline.

Based on the draft RPP PDP owned by Hukumonline, there is indeed no normative mention of PDN. Even so, PDN is regulated in      Regulation of the           President No. 95 of 2018 (Peraturan Presiden Nomor 95 Tahun 2018–      “ Perpres 95/2018 ”) on Electronic-Based Government Systems      (Sistem Pemerintahan Berbasis Elektronik–      “ SPBE ”), as a facility for the placement of electronic systems and related components for the purposes of placement, storage, processing, and data recovery     .

So it is important for Komdigi to meet the Indonesian National Standard      (Standar Nasional Indonesia–      “ SNI ”) regarding the feasibility of data center operations and management, so that there is no failure in protecting personal data.

“Hopefully it can be completed this year, along with the operation of PDN in Batam,” he concluded.
