The Ministry of Law (Kementerian Hukum – “Kemenkum”) is preparing Draft Bill on Criminal Adjustment or Draft Bill on the Adjustment of Criminal Provisions under laws and regulations of the regions. This policy will focus on adjusting the substance related to criminal provisions contained in a number of laws and regulations of the regions.
“There are several substances that will be adjusted based on the material of the new Criminal Code. The adjustment of the Draft Bill regarding the sentences that we have inventoried from 140 laws related to the regulation of sentences in Regulations of the Regions (Peraturan Daerah – “Perda”), one of which is in the form of fines in Article 615 of the new KUHP,” explained Institute for Criminal Justice Reform Researcher, Maidina Rahmawati to Hukumonline.
The Draft Bill on Criminal Adjustment will also regulate the application of special minimum sentences outside of special and cumulative crimes, to minimize the discrepancy between the body and the elucidation. Including other issues that need to be adjusted from the new Criminal Code.
