
New Electricity Business Regulation to be Enforced Soon

Deputy Minister of Energy and Mineral Resources (“ESDM”), Yuliot Tanjung has confirmed that the drafting of the Draft Regulation of the Government (“Draft Regulation”) on Electrical Power Supply Businesses (“UPTL”) will be completed in the near future. According to Yuliot, the Draft Regulation will affect the entire electrical power supply ecosystem.
“Hopefully, the drafting of the UPTL Draft Regulation will not take too long to be promulgated,” Yuliot told Hukumonline.
On the point of business licensing, this Draft Regulation regulates permits for Public Electric Vehicle Charging Stations (“SPKLU”), including permits for New and Renewable Energy (EBT) power plants as energy sources, which are conducted automatically through the One Single Submission (OSS) system. This new regulation will also govern licensing and Certificates of Operational Compliance (“SLO”) for power plants with a capacity of less than 10kW attached to main activity permits such as for Micro-, Small- and Medium-Scale Enterprises (“UMKM”).
Meanwhile, to accelerate electrical power supply, Yuliot explained that this Draft Regulation regulates flexibility in the implementation and revision of the Electrical Power Supply Business Plans (“RUPTL”). The latest regulation opens up the possibility of extending the RUPTL, which has been 10 years, to 15 years and can be revised in accordance with the orders of the Minister of ESDM and the evaluation of business actors, as well as in the event of additional infrastructure development outside the initial plan.
