New Government Regulation Allows Auditing and Freezing of Problematic Notary Organizations

The government is currently preparing a Draft Regulation of the Minister of Law (Rancangan Peraturan Menteri Hukum– “ RPMH ”) on the Establishment, Development, and Supervision (Penetapan, Pembinaan, dan Pengawasan– “ PPP ”) of Notaries. This draft regulation will cover aspects of the governance of notary organizations to improve the quality of notary services to the public, including their authority to carry out supervision, which encompasses dispute resolution related to the management of notary organizations.
“What’s interesting about the development aspect is related to finances. The state can audit notary organizations. The government can even freeze an organization if conflicts or disputes occur,” explained the Chairman of the Central Board of the Indonesian Notary Association (“ INI ”), Irfan Ardiansyah, to Hukumonline.
INI has also proposed several suggestions to improve the RPMH. Moreover, the main tasks and functions of the regulation are designed to adapt to the internal dynamics that often occur within organizations, especially notary associations.
“Because the role of notaries in society is also important. Their main tasks and functions include assisting state services in increasing Non-Tax State Revenue (Penerimaan Negara Bukan Pajak– “ PNBP ”) as well as providing legal certainty,” he concluded.
