OJK Finalizes Regulation on the Transfer of Crypto Market Oversight from Bappebti

The Financial Services Authority (“ OJK ”) is in the process of finalizing a draft amendment to OJK Regulation No. 27 of 2024 (“ POJK 27/2024 ”) on the Organization of Trading in Digital Financial Assets and Crypto Assets (Aset Keuangan Digital dan Aset Kripto– “ AKD-AK ”). This effort follows the submission of an addendum to the official handover minutes (Berita Acara Serah Terima/BAST) regarding the transfer of regulatory and supervisory authority over crypto assets and digital finance from the Commodity Futures Trading Regulatory Agency (Badan Pengawas Perdagangan Berjangka Komoditi– “ Bappebti ”).

“This POJK is intended to complement the provisions and norms governing the trading activities of AKD-AK derivatives, the regulatory and supervisory functions of which have been transferred from Bappebti to OJK,” said Head of Supervision for Financial Sector Technology Innovation, Digital Financial Assets, and Crypto Assets, OJK, Hasan Fawzi to Hukumonline.

Under the latest regulation, crypto assets are categorized as financial assets equivalent to securities and are therefore no longer subject to Value Added Tax (“ VAT ”). This aligns with Regulation of the Minister of Finance No. 50 of 2025 on Value Added Tax and Income Tax on Crypto Asset Trading Transactions (“ Permenkeu 50/2025 ”).

Nevertheless, domestic and foreign Organizers of Trading Through Electronic Systems (Penyelenggara Perdagangan Melalui Sistem Elektronik– “ PPMSE ”) remain subject to VAT and Income Tax on transactions conducted.

“It is expected to be completed in the second half of this year, so integration can begin in 2026,” he concluded.
