
OSS Synchronization: Ministry of Environment Aligns Regulations on AMDAL and UKL

The Ministry of Environment/Environmental Control Agency (“ KLH/BPLH ”) are currently drafting a revision of Regulation of the Minister of Environment and Forestry No. 4 of 2021 (“ PermenLHK 4/2021 ”). The regulation will be aligned with the Implementing Regulation of Risk-Based Business Licensing (“ PBBR ”) under the Online Single Submission (“ OSS ”) system.
Ardoni Eka Putra, the Expert on Environmental Impact Control, Directorate of Prevention of Business Environmental Impact and Activities, KLH/BPLH, stated that the revision is being carried out to adjust the classification of businesses and activities that are required to have an Environmental Impact Analysis (Analisis Mengenai Dampak Lingkungan– “ AMDAL ”), Environmental Management Efforts and Environmental Monitoring Efforts (Upaya Pengelolaan Lingkungan Hidup dan Upaya Pemantauan Lingkungan Hidup– “ UKL-UPL ”), and Statements of Ability to Manage and Monitor the Environment (Surat Pernyataan Kesanggupan Pengelolaan dan Pemantauan Lingkungan Hidup– “ SPPL ”), based on both the Indonesia Standard Industrial Classification (Klasifikasi Baku Lapangan Usaha Indonesia – “ KBLI ”) and non-KBLI categories. The regulation will apply to both business actors and government institutions.
"We are currently in the process of aligning it with the OSS system, as many KBLI classifications are still not compatible — that’s what we are working to adjust," said Ardoni to Hukumonline.
On the other hand, the Ministry of Investment and Downstream Industry/Investment Coordinating Board (“ BKPM ”) is finalizing the Draft Regulation of the Minister of Investment and Downstream to replace Regulation of BKPM No. 3 of 2021 , Regulation of BKPM No. 4 of 2021 and Regulation of BKPM No. 5 of 2021 . This new regulation will serve as the Implementing Guidelines and Technical Guidelines for Regulation of the Government No. 28 of 2025 on the Implementation of Risk-Based Business Licensing (“ PP 28/2025 ”), which replaces Regulation of the Government No. 5 of 2021 (“ PP 5/2021 ”), which is targeted to be completed before October this year.
