The Association of Civil Law Lecturers (Asosiasi Pengajar Hukum Keperdataan/APHK) initiated a discussion and academic study for the renewal of the Law on Obligations, as stipulated in Book III of the Civil Code (Kitab Undang-Undang Hukum Perdata – “KUHPerdata”). The Director of the Postgraduate Program at Borobudur University, Prof. Faisal Santiago, expressed the need for legal renewal in line with the development of the law of obligation regulations amidst technological and digital developments.
“In its country of origin, the Burgerlijk Wetboek (“BW”) or Civil Code has been reformed several times, while we are still using the BW inherited from the Dutch, so it is no longer adequate for the current digital conditions,” explained Prof. Faisal to Hukumonline.
In general, the preparation of the latest version of academic paper for the draft bill (rancangan undang-undang – “RUU”) on the Law on Obligations will focus on the interaction of agreements between humans involving technology, such as digital signatures, to the level of confidentiality of a business agreement.
““This June we will submit the academic paper and draft articles of the Draft Bill on the Law of Obligations to the DPR,” he concluded.
