Points of Regulation of PP Derivative of UU Minerba

Discussion of Regulation of the Government (Peraturan Pemerintah/PP) derived from Law No 2 of 2025 on the Fourth Amendment to Law No. 4 of 2009 on Mineral and Coal Mining (Pertambangan Mineral dan Batubara – “Minerba”) (collectively referred to as “UU 4/2009”) is still being processed.

The Director General of Mineral and Coal of the Ministry of Energy and Mineral Resources (Energi dan Sumber Daya Mineral – “ESDM”), Tri Winarno, revealed that the points of the derivative PP will complement a number of mandates of UU 4/2009, not only the fourth amended version, but also the previous version of the UU.

Tri explained that the draft PP will later contain provisions on domestic fulfillment obligations before export, provisions on giving priority to Mining Business Permit Areas (Wilayah Izin Usaha Pertambangan – “WIUP”)/ Special WIUP (“WIUPK”), o provisions on environmental permits before the Coal Contract of Work (Perjanjian Karya Pengusahaan Pertambangan Batubara – “PKP2B”).

The preparation of the derivative PP will be completed soon, considering the mandate of the UU which regulates the completion of derivative PP within 6 months after the ratification of UU 4/2009. "It is being prepared. Soon," he added.
