The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (“ATR/BPN”) is exploring the possibility of introducing regulations on the limitation of land control and ownership. At present, this initiative remains at the stage of academic study conducted by the Directorate General of Land and Spatial Control and Enforcement (“Ditjen PPTR”).
“There is an opportunity to regulate this matter, and to date an academic study on such limitations has already been carried out,” said Pramusinto, Head of the Subdirectorate for Enforcement of Land Use and Utilization.
He explained that the academic study is being conducted as a preventive measure to ensure that land abandonment does not occur from the outset. The focus is on the regime governing land control and ownership, under which the government seeks to regulate the maximum threshold of land holdings by both individuals and legal entities. This responds to input indicating that a significant number of land abandonment cases occur because certain parties control land beyond their capacity to properly manage it.
It is expected that the outcome of this study will eventually give rise to formal regulations. The preparation of the study involves agrarian law academics to provide a strong theoretical and juridical foundation for formulating such a policy on ownership and control limitations.
