The Legislation Body (“Baleg”) of the House of Representatives of the Republic of Indonesia (“DPR RI”) has agreed on a draft revision of Law No. 22 of 2009 on Road Traffic and Transportation, as amended by Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation (collectively referred to as “Law 22/2009”). The legislation also addresses the crucial issue of the legal status and protection of drivers in technology-based transportation, which still requires alignment with labor regulations.

“This protection aims to provide legal certainty and safeguards for drivers of information technology-based transportation services, as well as to ensure the fulfillment of drivers’ rights to social security,” said Martin Manurung, Deputy Chair of the Baleg of DPR RI

According to the draft obtained by Hukumonline, as stipulated in Article 225A, paragraph (3), app-based companies must provide social security to drivers, ensure a safe working platform, and establish fair and transparent income. Furthermore, drivers of information technology-based transportation services are now recognized as having the right to form unions and organizations, access their performance data, and receive legal assistance in dispute resolution.

“The government will also develop a system for managing traffic accident and road transport funds to provide basic protection to victims of traffic accidents and road transport incidents,” he explained.
