PU Amends Regulations on Toll Road Development by Business Entities

The Ministry of Public Works (“PU”) is currently drafting a Regulation of the Minister of Public Works (“Draft Regulation”) on Procedures for Determining Toll Road Operations on the Initiative of Business Entities to replace Minister of Public Works and Public Housing (“PUPR”) No. 23 of 2021 (“Regulation 23/2021”).

“This draft regulation of the minister is expected to provide clarity for business entities regarding the completeness of the application files that need to be fulfilled and certainty regarding the time frame for the initiative determination process,” said the Director-General of Public Works Infrastructure Financing (Dirjen PI), Rachman Arief Dienaputra.

This Draft Regulation determines provisions on the criteria for initiative projects, the stages in determining initiative projects, the procedures for using compensation rights, and land acquisition for projects. In addition, this draft also regulates the revocation of the status of business entities as initiators and the transfer of government and business entity cooperation initiatives.

According to Arief, the implementation of Regulation 23/2021 has experienced many dynamics, including the implementation of procedures that are not yet optimal. In addition, changes were made to align with Regulation of the Government No. 23 of 2024 on Toll Roads (“Regulation 23/2024”) and Regulation of the Minister of National Development Planning/Head of the National Development Planning Agency (Bappenas) No. 7 of 2023 , Regulation of the Minister of Finance No. 68 of 2024 , and Regulation of the National Public Procurement Agency (LKPP) No. 1 of 2025 .
