
Receivers Profession to Soon Have Its Own Legal Framework

The Indonesia’s House of Representatives (“ DPR ”) has begun discussing the Draft Law on Receivers Profession (Rancangan Undang-Undang tentang Profesi Kurator– “ RUU Kurator ”). This legal instrument aims to further regulate the roles and responsibilities of receivers in bankruptcy and suspension of debt payment obligation (Penundaan Kewajiban Pembayaran Utang– “ PKPU ”) processes in Indonesia.
“We are still focusing on the 2025-2049 Priority National Legislation Program (Prolegnas),” said Martin Manurung, a member of the DPR’s Legislative Body (Baleg), in an interview with Hukumonline.
This RUU is also expected to regulate the dispute resolution mechanisms involving receivers, whether disputes arise between curators and debtors, creditors, or other third parties. This regulation aims to provide legal certainty and efficiency in resolving such conflicts.
Currently, all regulations on the receivers profession still refer to Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations (“ UU 37/2004 ”) and its implementing regulations. Namely, Regulation of the Minister of Law and Human Rights No. 37 of 2018 on the Requirements and Procedures for Registration as well as Reporting by Receivers and Administrators (“ Permenkumham 37/2018 ”) and Regulation of the Minister of Law No. 20 of 2025 on Guidelines for the Amount of Fees for Receivers and Administrators (“ Permenkum 20/2025 ”).
