
Regulation on Mandatory Enforcement of Human Rights in Business Set to Begin in 2026

Deputy Minister of Human Rights (“ HAM ”) Mugiyanto stated that the formulation of draft Presidential Regulation (“ Rperpres ”) on the mandatory enforcement of HAM in the business sector has been completed. Mugiyanto said that the implementation of the new regulation will begin as early as 2026, while awaiting the readiness of all relevant stakeholders.
“Approximately as early as 2026, but also possible in 2027,” said Mugiyanto to Hukumonline.
According to Mugiyanto, the draft regulation, which targets all business processes from planning to the end of operations, refers to international standards. One of the guiding principles of this RPerpres is based on the United Nations Guiding Principles on Business and Human Rights, which consist of three pillars: protection of HAM by the state from third parties, corporate respect for HAM, and victims’ right to remedies.
Mugiyanto illustrated this principle through the implementation of HAM in the mining sector. According to him, recovery efforts have so far focused only on environmental aspects after mining activities. When this new Presidential Regulation is implemented, companies will be required to carry out recovery not only for the environment but also for the communities affected in the post-mining areas.
“Damaged land, affected communities, and so on. This approach is comprehensive, whereas the current measures are partial, focusing only on environmental impacts,” he emphasized.
