The Judicial Commission (Komisi Yudisial – “KY”) is currently drafting the Second Amendment to Judicial Commission Regulation No. 2 of 2016 on the Selection of Supreme Court Justice Candidates (“PerKY 2/2016”). One of the key points of the amendment is the removal of the requirement to attach a letter of recommendation for individuals participating in the selection of Supreme Court Justice Candidates (Calon Hakim Agung – “CHA”).
“It is currently under discussion at the KY plenary meeting,” said KY Member Andi Muhammad Asrun to Hukumonline.
KY will also limit the opportunity for individuals to participate in the CHA selection process to a maximum of three times. In addition, KY plans to open broader opportunities for individuals outside the Tax Court to participate in the selection of CHA at Administrative Court (“TUN”) with a tax specialization as non-career judge. This policy is linked to the difficulty faced by candidates with career-judge backgrounds in meeting the relevant requirements.
“It is targeted to be completed this year if there are no further changes,” he added.
