Regulations Implementing the Domestic Workers Protection Law Issued Following Completion of the Labor Protection Draft Bill

The Ministry of Manpower (“Kemenaker”) has nearly completed the drafting of implementing regulations for Law No. 2 of 2026 on the Protection of Domestic Workers (“PPRT Law”). However, the finalization of these regulations is still pending the deliberation of the Draft Bill on Labor Protection.

Isnarti Hasan, Director of Labor Placement at Kemenaker, revealed that the government is preparing to consolidate four Draft Regulations of the Government (“Draft Regulations”) into a single integrated Draft Regulations as well as one Regulation of the Minister of Manpower.

“We are all still focusing first on the Draft Bill on Labor Protection; afterward, we can proceed with finalizing the four existing Draft Regulations, which will be consolidated into one, along with one Regulation of the Minister of Manpower,” she said.

The implementing regulations of the PPRT Law cover four main pillars of protection for domestic workers (“PRT”). First, wage regulations based on mutual agreement with a minimum threshold, including the formulation of a wage index for part-time workers. Second, the governance of Domestic Worker Placement Agencies (“P3RT”) through risk-based licensing. These regulations include a ban on wage deductions, placement fees, the withholding of personal documents, and the enforcement of binding contracts. P3RTs are also required to provide orientation prior to placement and to supply replacement PRT. 

Third, the fulfillment of domestic workers’ rights to social security, rest periods, and a safe working environment. Fourth, establishing a tiered system for supervision and dispute resolution, ranging from the RT/RW and sub-district levels to formal mediation at the Department of Labor.

Through this consolidation, the Ministry of Manpower plans to align the substance of the implementing regulations for the PPRT Law with the provisions in the Draft Bill on Labor Protection before proceeding with the finalization of the regulations.
