The Ministry of Law (“Ministry”) is finalizing the Draft Regulation of the Government (“Draft Regulation”) related to the Patent Appeal Commission. This policy will regulate the working mechanisms of the Patent Appeal Commission to be more systematic and substantive in handling appeals of patent and trademark disputes.
“The draft is still being prepared, with the aim of simplifying the administrative and substantive examination procedures for those filing appeals in patent disputes,” said Razilu, Director-General of Intellectual Property Rights (“Directorate-General”) at Ministry, to Hukumonline.
Furthermore, the preparation of this Draft Regulation is a priority for Directorate-General in its efforts to improve the quality of national intellectual property services, particularly in terms of a fair and accountable patent appeal system. As stipulated in Law No. 13 of 2016 on Patents (“Law 13/2016”), the Directorate-General has the duty to receive, examine, and decide on appeals against rejections and requests for registration of appeals.
