Revision of Export Trade Regulations for Freeports Copper Concentrate

The Ministry of Energy and Mineral Resources (ESDM) officially reissued a copper concentrate export license for PT Freeport Indonesia which experienced a force majeure event last year. The permit is contained in Regulation of the Minister of Energy and Mineral Resources ("Minister") No. 6 of 2025 on the Amendment to Regulation of the Minister No. 5 of 2024 on the Completion of Construction of Domestic Refinery Facilities for Metal Minerals (“Regulation 6/2025”).

Although an export permit has been issued to PTFI, Secretary General of the Ministry of Energy and Mineral Resources, Dadan Kusdiana, stated the need to amend Regulation of the Minister of Trade No. 11 of 2024 on Export Policies and Regulations (“Regulation 11/2024”). The amendment will later facilitate the issuance of an Export Approval (Persetujuan Ekspor – “PE”) for copper concentrate.

“A revision of Regulation of the Minister of Trade is needed, so from here (ESDM), it will go there (Ministry of Trade)," said Dadan.

The Deputy Minister of ESDM, Yuliot Tanjung, explained that the reinstatement of export permits was carried out through an intersectoral limited meeting led by the Coordinating Ministry for Economic Affairs. Following the enactment of Regulation 6/2025, a revision regarding export provisions will follow as a result of that policy.

“The issuance of the regulation was discussed at the coordination meeting of Coordinating Ministry for Economic Affairs,” Yuliot explained to Hukumonline.
