Ministry of Indonesian Migrant Workers Protection (“ KemenP2MI ”) is finalizing the draft revision of Law Nomor No. 18 of 2017 on the Protection of Indonesian Migrant Workers (“ Law 18/2017 ”). The amendment to the regulation will add several new points, one of which establishes crew members (“ ABK ”) and Sailors as Indonesian migrant workers (“ PMI ”) who must be protected by the state.
“Yes, since it has been included in the Priority Prolegnas 2025, we hope that by mid-next year it can be discussed by the DPR's Legislation Body so that it can be enacted,” said the Deputy Minister of the Ministry of KemenP2MI, Zulfikar Ahmad Tawalla, to Hukumonline.
Substantively, the draft revision of Law 18/2017 will add several points, including empowerment clauses, promotion, and aspects of capacity building for migrant workers outside Indonesia.
This includes adding protection points for crew members and sailors as part of PMI, in accordance with the Constitutional Court's decision (MK) regarding the judicial review of Article 4 paragraph 1 letter c of Law 18/2017.
