Revision of Permentan on Plant Variety Protection Prepared, Covering Objections and Seed Labeling

The Ministry of Agriculture is currently discussing amendment to Regulation of the Minister of Agriculture No. 25 of 2021 on Applications for Plant Variety Protection Rights (“ Permentan 25/2021 ”). The amendments are being made in response to developments in breeding technology, dynamics within the seed industry, global trade, and the utilization of information technology in Plant Variety Protection (Perlindungan Varietas Tanaman- “ PVT ”) services.

“This regulation is intended to ensure transparency, provide room for public participation, and ensure that the process of granting PVT rights takes into account opinions, objections, and clarifications in an objective and measured manner, including through mediation facilitated by the PVT and Center PTPP, if necessary,” stated Leli Nati, Head of the Plant Variety Protection and Agricultural Licensing Center (Perlindungan Varietas Tanaman dan Perizinan Pertanian-“ PPVTPP ”).

The substance of the prepared amendments includes seven main points. First, the regulation of the objection mechanism in PVT applications to ensure transparency and public participation, including mediation facilitated by the Center PTPP. Second, a clarification of the role of the PVT Commission on the issuance of the Decree of the Minister of Agriculture. Third, the regulation of PVP management fees, including incentive policies and their relation to Non-Tax State Revenue (PNBP). Fourth, the clarification of regulations regarding PVT rights that are transferred due to the death of the owner or assignment of rights. Fifth, the obligation to include the PVT logo on the packaging of distributed seeds. Sixth, the strengthening of mechanisms for addressing PVT rights violations through criminal or civil channels, with the option of restorative resolution. Seventh, the optimization of digital services through the Apply PVT application to accelerate the application process.

The amendment to Permentan 25/2021 is targeted for completion this year and has been included in the Ministry of Agriculture’s 2026 legislative program. The revision is expected to serve as an operational reference for the implementation of plant variety protection services in Indonesia.
