Trade Protection and Safeguard is one of the articles proposed in the Draft Bill on Strategic Commodity (“Strategic Commodity Draft Bill”). Article 52 of the draft bill encourages the establishment of policies for the protection and safeguarding of trade in strategic commodities.
This draft bill also covers a number of trade safeguard measures, including defense against allegations of dumping or subsidies on exports. It also includes defense for strategic commodity traders whose export products are deemed by other countries to cause a surge in imports in those countries.
Director of Domestic Trade at the Ministry of Trade, Iqbal Shoffan Shofwan, said that provisions on trade safeguard are generally regulated in Law No. 7 of 2014 on Trade, as amended by Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation (collectively referred to as “Law 7/2014”). The strengthening of trade safeguards, particularly for export commodities, is one of the focuses of the amendment to Regulation of the Government No. 34 of 2011 on Antidumping Measures, Countervailing Measures, and Safeguard Measures (“PP 34/2011”).
“Currently, the Ministry of Trade is discussing the revision of PP 34/2011 related to anti-dumping measures, countervailing measures, and trade safeguard measures,” said Iqbal.
