The Ministry of Home Affairs (“ Kemendagri ”) is currently drafting a Draft Bill on the Fifth Amendment to Law No. 23 of 2014 (“ UU 23/2014 ”) on Regional Government (“ RUU Pemda ”). The drafting of the RUU Pemda aims to address various issues of overlapping authorities in the implementation of regional autonomy.
“It is still in progress because we need to improve and strengthen the policy database and ensure that every decision is made based on accurate data. The discussion of this RUU must be thematic in order to be more focused and implementable,” said Akmal Malik, Director General of Regional Autonomy at the Ministry of Home Affairs, to Hukumonline.
It should be noted that several provisions in the RUU Pemda have been adjusted through various sectoral regulations, including those related to the Job Creation, the Fiscal Relations between the Central and Regional Governments (Hubungan Keuangan antara Pemerintah Pusat dan Daerah- “ HKPD ”), Water Resources (Sumber Daya Air- “ SDA ”), and Minerals and Coal (“ Minerba ”). RUU Pemda is also included in the 2025 priority discussion list and is proposed as a joint initiative of the Indonesia’s House of Representatives and/or the Regional Representative Council, together with Kemendagri.
