Commission V of Indonesia’s House of Representatives (“ DPR RI ”) will amend Law No. 22 of 2009 on Road Traffic and Transportation, as amended by Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation (collectively referred to as “ Law 22/2009 ”). The amendment to Law 22/2009 will provide stricter and more detailed regulations on sanctions and the responsibilities of logistics truck owners.
“Up to now, whenever there is an accident, it is always the driver who ends up in prison. The vehicle owner has never been imprisoned, nor has the owner of the goods — it’s always the driver. Yet the driver is often in a position where they are forced to transport the load,” said the Chairperson of Commission V of the DPR RI, Lasarus.
In addition, the amendment to Law 22/2009 incorporates proposals from logistics driver associations. These include the extension of the validity period for B1 and B2 Driving Licenses (“ SIM ”) without requiring payment of Non-Tax State Revenue (PNBP), the provision of housing subsidies, and educational guarantees for drivers’ children. These matters are being deliberated jointly within a special team formed with the government.
The Minister of Transportation (“ Menhub ”), Dudy Purwagandhi, will soon coordinate with several institutions, including the Ministry of Primary and Secondary Education (Kemendikdasmen) and the Ministry of Higher Education, Science, and Technology (Kemendiktiksaintek). His ministry is also working with the Indonesian National Police Force (Polri) to formulate regulations on Zero Over Dimension Over Loading (“ ODOL ”).
“We will formulate the activities or steps that need to be taken. The timeline is already clear—by 2027, we must achieve zero ODOL,” said Dudy.
