Draft Regulation of the President (“RPerpres”) on the Assessment of Business Compliance with Business and Human Rights Principles will establish 13 indicators for assessing business actors’ compliance with human rights principles. Deputy Minister of Human Rights Mugiyanto Sipin stated that these indicators were developed with reference to national and international regulations to ensure the effective implementation of human rights principles.
“Existing international and national regulations are used as references to ensure the fullest possible implementation,” Mugiyanto told Hukumonline.
The 13 indicators cover employment; children and vulnerable groups; working conditions; trade unions; supply chains and procurement policies; data protection and privacy; anti-discrimination; gender; the environment and climate change; corruption in the business sector; land and Indigenous Peoples; security; and access to remedy.
The assessment of human rights risks and impacts will be conducted through a human rights due diligence process. This process includes integrating human rights policy commitments into corporate management systems, identifying risks and assessing impacts, and taking measures to prevent and mitigate adverse human rights impacts.
The process also includes monitoring, establishing internal grievance mechanisms, public reporting and communication, and providing access to remedy for affected parties.
