Draft Regulation of the Government (Rancangan Peraturan Pemerintah- “ RPP ”) on the Organization of Spatial Planning (“ RPP on Spatial Planning ”) contains a specific chapter on dispute resolution, as part of efforts to support sustainable spatial planning. The RPP on Spatial Planning constitutes a revision of Regulation of the Government No. 21 of 2021 on the Organization of Spatial Planning (“ PP 21/2021 ”) and extensively regulates the business processes of spatial planning.

“Specifically, there will be involvement of the Spatial Planning Committee or Forum in the event of disputes arising from differences in policy between levels of government or across sectors,” said Djuang Fadjar Sodikin, Assistant Deputy for the Organization of Spatial Planning and Agrarian Affairs, in a statement to Hukumonline.

Fadjar explained that dispute resolution may be carried out through deliberation and consensus or through the courts. In addition, the RPP on Spatial Planning also incorporates a quality control aspect into the provisions on Norms, Standards, Procedures, and Criteria (Norma, Standar, Prosedur, dan Kriteria- “ NSPK ”), with the aim of ensuring that spatial planning products are better able to optimally guide the use of limited land resources.
