
RPP on the Implementation of KUHAP Regulates the Scope of Criminal Offenses Eligible for DPA, Including Their Time Limits

The Government is currently drafting a Regulation of the Government (“PP”) on the Implementation of Law No. 20 of 2025 on the new Criminal Procedural Law (Kitab Undang-Undang Hukum Acara Pidana -“KUHAP”). Deputy Minister of Law Edward Omar Sharif Hiariej stated that the draft regulation will govern the procedures for Deferred Prosecution Agreements (“DPA”).
Eddy explained that the Draft PP on the Implementation of KUHAP will address several issues relating to DPAs that are not regulated in detail under the KUHAP. These include, for example, the limitations on the types of criminal offenses for which DPAs may be applied, as well as the mechanisms for extending the duration of a DPA.
“Regarding the DPA, it is true that we did not set any limitation on the types of criminal offenses within the KUHAP. We expect that this will be further regulated in a Regulation of the Government,” Eddy stated.
Eddy further noted that the RPP on the Implementation of KUHAP consists of 234 articles. According to him, the Ministry of Law will soon hold meetings with law enforcement authorities to discuss the substance of the draft RPP. In addition to law enforcement agencies, Eddy said the Ministry has also invited several academics to participate in providing input on the draft regulatory text.
