RUU HAM Strengthens Business Actors Compliance

The Ministry of Human Rights (“ KemenHAM ”) is currently preparing a revision of Law No. 39 of 1999 on Human Rights (“ RUU HAM ”). One of the key provisions to be emphasized in the RUU HAM is the strengthening of Business Actors’ compliance through a HAM Due Diligence mechanism.

“One of the points relates to Business and Human Rights, as reflected in the use of the Business and Human Rights Risk Assessment application (Penilaian Risiko Bisnis dan HAM– “ PRISMA ”) by KemenHAM,” revealed a source from the Directorate for the Preparation and Evaluation of HAM Instruments at KemenHAM, who wished to remain anonymous, in a statement to Hukumonline.

This initiative serves as an initial step in implementing HAM Due Diligence, as outlined in the Circular of the Director General of Human Rights Services and Compliance No. PDK‑HA.02.01.03‑01 of 2025 on the Self-Reporting of the PRISMA Application and the HAM Compliance Implementation Plan in Business Practices (“ SE Dirjen 02/2025 ”). Through this policy, PRISMA is established as a business and HAM risk assessment instrument for Business Actors, while also emphasizing that the obligation to conduct HAM Due Diligence will, going forward, apply to all Business Actors.

Furthermore, the RUU HAM is currently included in the 2026 Priority National Legislation Program (“ Prolegnas ”) of Indonesia’s House of Representatives. “It should have made the shortlist because it has already undergone the Inter-Ministerial Discussion (Pembahasan Antar Kementerian- “ PAK ”),” he added.
