The Ministry of Trade is currently drafting Regulation of the Minister of Trade as a derivative of the Regulation of the Government on the Management of Exports of Natural Resource Commodities (“SDA”). Minister of Trade Budi Santoso revealed that the new ministerial regulation will govern export procedures through PT Danantara Sumberdaya Indonesia (“DSI”) starting 1 January 2027.
“So, as I mentioned earlier, the obligations, the rules, and the export procedures remain unchanged. What changes is that, effective 1 January, PT DSI will be the entity handling them,” said Budi. He assured that other export provisions, such as licensing and the Domestic Market Obligation (“DMO”), will not be altered.
Budi aims to finalize several technical Regulations of the Minister of Trade in the near future before the transition period begins on June 1, 2026. At least three Regulations of the Minister are currently being prepared for each affected commodity.
For palm oil, Draft Regulation of the Minister of Trade (Draft Regulation) on Palm Oil Export Regulations is being drafted, which will repeal Regulation of the Minister of Trade No. 26 of 2024, as amended by Regulation of the Minister of Trade No. 2 of 2025 (collectively referred to as “Regulation 26/2024”). This new regulation will also govern the transfer of export rights for business actors that fulfill the DMO.
Coal exports through PT DSI will be regulated by the Draft Regulation on Coal Export Provisions, which will repeal Regulation of the Minister of Trade No. 23 of 2023, as amended most recently by Regulation No. 12 of 2026 (collectively referred to as “Regulation 23/2023”). This new regulation also sets out the requirements for registered exporters.
The final commodity, ferroalloy, will be regulated under the Draft Regulation on Ferroalloy Export Regulations, which will also repeal Regulation 23/2023. This new regulation will require the use of a Surveyor’s Report (LS) as a mandatory condition for exports through PT DSI.
