The Ministry of Communication and Digital Affairs (Ministry) has finalized the Draft Regulation of the Government ("Draft Regulation") of Law No. 27 of 2022 on Personal Data Protection ("PDP Law"). The policy will provide detailed provisions on the rights and obligations of data owners and controllers, procedures for data processing and cross-border data transfers, compliance monitoring, and dispute resolution mechanisms.
“As per the planned schedule, it will be submitted to the President this August,” said Radita Ajie, Head of the Legal Affairs Bureau at Ministry, to Hukumonline.
Under this regulation, personal data is defined as information about an identified or identifiable individual, either directly or indirectly, through electronic or non-electronic systems. Personal data is divided into two categories: specific data and general data.
General data includes full name, gender, religion, nationality, marital status, and combinations of information that can identify an individual.
“This Draft Regulation will complement the penalty provisions already stipulated in the PDP Law,” he added.
