The Directorate-General of Intellectual Property Finalizes Rules on Songs and Music on Digital Platforms

Directorate-General of Intellectual Property (Directorate-General) of the Ministry of Law is finalizing a Draft Regulation of the Government (“Draft Regulation”) on Song and/or Music Licensing (Song and/or Music Licensing Draft Regulation).

Director of Copyright and Industrial Design at the Ministry of Law Agung Damarsasongko explained that the substance of the Draft Regulation also provides a legal framework for regulating licenses on digital platforms, which were previously not specifically regulated in Law No. 28 of 2014 on Copyright (“Law 28/2014”).

“It does not explicitly abolish or replace the role of Collective Management Organization (Lembaga Manajemen Kolektif/LMK) entirely. This may grant copyright holders more specific authority to control the use of their works in the digital realm, which may differ from the collective licensing model that has been in place so far,” Agung explained to Hukumonline.

Furthermore, the Song and/or Music Licensing Draft Regulation will focus more on licensing regulations in the digital era, including moral rights and economic rights of Creators, Copyright Holders, and Related Rights Holders in the Songs and/or Music sector, Digital Service Providers, and Intermediaries of Digital Service Providers. This includes considering international standards and global best practices in copyright protection.

“It is targeted to be completed in the not too distant future,” he concluded.
