The Government Drafts an Institutional Transition Scheme for the Personal Data Protection Agency

The government, through the Directorate General of Legislation (DJPP) of the Ministry of Law, is finalizing the discussion of the Draft Regulation of the President (" Draft Regulation ") on the Personal Data Protection (" PDP ") Agency. The institutional structure of the PDP Agency is designed as a non-ministerial government institution under the President and is responsible to the Minister of Communication and Digital Affairs (" Komdigi "), in accordance with the mandate of Law No. 27 of 2022 on Personal Data Protection (" PDP Law ").

"The substance under discussion includes the institutional transition process from the Directorate General of Digital Space Supervision at the Ministry of Communication and Digital Affairs to the PDP Agency, including the transfer of personnel, equipment, documents, and funding," said Radita Ajie, Head of the Legal Bureau of the Ministry of Communication and Digital Affairs, to Hukumonline.

The discussion of the Draft Regulation also highlights the duties and functions of the PDP Agency, including its authority to establish technical policies, supervise compliance, enforce administrative law, and facilitate dispute resolution. The transition process is planned to take place gradually over a maximum period of two years from the enforcement of this Regulation of the President.

"The draft is still being refined in the Inter-Ministerial Discussion (PAK)," he added.
