The Government Revokes Three Laws for the Omnibus Law on Housing

The government is currently preparing a Draft Bill on Housing and Settlement Areas (PKP). This omnibus legal instrument will revoke three existing regulations, namely Law No. 1 of 2011 on Housing and Settlement Areas (“ Law 1/2011 ”) and Law No. 20 of 2011 on Multi-story Housing (“ Law 20/2011 ”), both of which were amended by Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation, as well as Law No. 4 of 2016 (“ Law 4/2016 ”) on the Public Housing Saving (Tabungan Perumahan Rakyat– “ Tapera ”).

"Later, the three Laws will be entirely revoked, along with certain related articles from Law No. 23 of 2014 on Regional Government and Law No. 5 of 1960 on the Basic Agrarian Principles,"said a source at the Ministry of Housing and Settlement Areas to Hukumonline.

The proposed target for completing the PKP Draft Bill will be included in the Revision of 2025 Priority National Legislation Program (Prolegnas). This Draft Bill is expected to be more integrated and less confusing for developers and other parties involved in housing development.

“The preparation of the Government’s List of Issues (Daftar Inventarisasi Masalah– “ DIM ”) for the PKP Draft Bill is targeted for August–September. Hopefully, the discussions can be completed by November,” he concluded.
