The Ministry of Communication and Digital Affairs (“Ministry”) is in the process of preparation of Draft Regulation of the Minister (“Draft Regulation”) as a technical regulation for the implementation of Regulation of the Government No. 17 of 2025 on Governance of the Organization of Electronic Systems in Child Protection (“Regulation”). The Head of the Legal Bureau at Ministry Radita Ajie explained that the regulation will emphasize the obligation of verification and protection of children’s data, which is the responsibility of private digital platform operators.
“After all, in order to be implementable, there needs to be harmonization between ministries/agencies and digital platforms. Considering that this Draft Regulation regulation will place more emphasis on Electronic System Operators (Penyelenggara Sistem Elektronik - “PSE”),” Radita told Hukumonline.
Furthermore, this regulation also covers the obligation of platforms to educate parents and children, as well as administrative sanctions for violators. This is in line with the finalization of a Joint Decree (Joint Decree) across ministers that is being prepared to ensure more coordinated and effective implementation in the field.
“It is targeted to be completed before the second quarter of this year,” he added.
