The government is preparing Draft Regulation of the President on the establishment of the Personal Data Protection (“ PDP ”) Agency, as mandated by Law No. 27 of 2022 on Personal Data Protection (“ PDP Law ”). This agency is considered essential in addressing the dynamics of global trade, such as tariff policies introduced by Trump.
Danrivanto Budhijanto, a lecturer at the Faculty of Law of Universitas Padjajaran, stated that the draft regulation must refer to the PDP Law, which mandates functions of policymaking, supervision, and control.
“One of its functions is dispute resolution, which appears to be a distinguishing feature compared to other authorities,” he told Hukumonline.
In addition to resolving disputes related to personal data, particularly in high-risk sectors, Danrivanto added that this Agency is seen as vital for addressing the dynamics of global trade, such as the Trump-era tariff policies. The presence of a personal data authority will position Indonesia at the forefront of digital trade negotiations.
This Agency may assist the Ministry of Foreign Affairs, the Ministry of Trade, and the Ministry of Communication and Digital Affairs in addressing trade issues involving the personal data of Indonesian citizens.
