The government, through the Directorate General of Legislation (DJPP), is finalizing the Draft Bill (“RUU”) on Criminal Adjustments. Acting Director of Legislative Drafting, Hendra Kurnia Putra, stated that this RUU serves as a complement to the criminal provisions from various sectoral laws in the new Criminal Code (“KUHP”).
"This policy will focus on adjusting the substance of criminal provisions contained in several laws and regional regulations," Hendra told Hukumonline.
The formulation of articles in the RUU on Criminal Adjustment is mandated by Articles 613 and 615 of Law No. 1 of 2023 on KUHP (“Law 1/2023”). RUU on Criminal Adjustment will also regulate the application of special minimum penalties outside of special and cumulative criminal offenses, as well as aim to minimize inconsistencies between the main text of the law and its elucidation.
"We aim to complete it in the near future so that it can be submitted to the DPR for the next stage of legislative process," he added.
