
UNESCO Recommendation Becomes the Reference for AI Regulations

The Ministry of Communication and Digital (“Ministry”) has finalized the draft regulation for Artificial Intelligence (“AI”) in the 3rd quarter of 2025. The draft regulation will emphasize on ethics, privacy, cyber security and data protection, as well as copyright problems from AI innovation.
“It seems like (the Ministry) will follow the direction from UNESCO’s recommendation for AI governance and ethics in the preparation of its regulation,” said the Executive Director of Information and Communication Technology (ICT) Institute, Heru Sutadi, to Hukumonline.
This is necessary to complement the Circular of the Minister of Communication and Informatics No. 9 of 2023 on Ethics of Artificial Intelligence (“Circular 9/2023”), which contains the value and principle of ethics for business actors, organizers of public electronic system, and organizers of private electronic system which have artificial intelligence-based programming activities.
Furthermore, according to him, the Ministry also considers the best practice from European Union (“EU”) AI Act which organizes AI system based on its risk level.
“We should adopt the best practice that has been conducted by many countries,” he said.
